1) Acceptance of Terms

By accessing or using our websites, mobile apps, or services (collectively, the “Services”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases. If you are under 18, a parent/guardian must supervise your use. By using the Services, you represent and warrant that you meet these requirements.

3) Account Registration & Security

You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. Notify us immediately of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion.

4) Orders, Pricing, & Availability

• All orders are offers to buy subject to acceptance by us. We may reject or cancel any order (e.g., suspected fraud, stock errors, pricing mistakes).

• Prices, promotions, and availability may change without notice. Display errors may occur; if so, we may cancel or contact you for instructions before shipping.

• We reserve the right to limit quantities per person, household, or order.

5) Payment & Billing

You authorize us (and our payment processors) to charge your selected payment method for the total order amount, including taxes, duties, shipping, and any applicable fees. We may use third-party fraud screening; orders may be delayed or canceled pending verification.

6) Shipping, Risk of Loss, & Title

Shipping dates are estimates only. Risk of loss and title pass to you upon delivery to the carrier (or as required by mandatory law). You are responsible for providing a safe, correct delivery address.

7) Returns, Exchanges, & Refunds

Returns/exchanges are accepted only in accordance with our then-current Return Policy, which is incorporated by reference. Items must be in original condition and accompanied by proof of purchase unless our policy states otherwise. Certain items may be final sale or non-returnable.

8) Promotions, Gift Cards, & Credits

Promotional offers, coupons, and gift cards are subject to additional terms, may be time-limited, non-transferable, and may not be combined. We may modify or cancel promotions at any time.

9) User Content & Reviews

If you submit reviews, photos, or other content (“User Content”), you grant Gemini X a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media. You represent you own or control the rights to your User Content and that it does not infringe any rights or violate any laws.

10) Acceptable Use (Prohibited Conduct)

You agree not to:

• Break the law or violate rights (IP, privacy, publicity).

• Upload malware, disrupt the Services, or attempt to circumvent security.

• Scrape, spider, or harvest data without written permission.

• Misrepresent your identity, impersonate others, or engage in fraud.

• Use the Services for resale without authorization or for any harmful/illegal purpose.

We may monitor, remove, or restrict content and accounts that violate these Terms.

11) Intellectual Property

All content, trademarks, logos (including Wonder Toys and Gemini X), product images, text, software, and other materials on the Services are owned by Gemini X or its licensors and are protected by law. No rights are granted except as expressly set out in these Terms. You may not use our marks without our prior written consent.

12) Third-Party Links & Services

The Services may link to third-party sites or integrate third-party services. We are not responsible for third-party content, products, or practices. Your use of them is at your own risk and subject to their terms.

13) Privacy

Our Privacy Policy describes how we collect, use, and disclose personal data. By using the Services, you consent to our data practices. Where required by law, we will seek additional consent.

14) Warranties & Disclaimers

To the maximum extent permitted by law, the Services and all products are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted/secure/ error-free operation. Some jurisdictions do not allow disclaimers, so some limitations may not apply to you.

15) Limitation of Liability

To the fullest extent permitted by law, Gemini X, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenues, data, goodwill, or business interruption, arising out of or related to the Services or products.
Our total aggregate liability for any claim shall not exceed the amount you paid to Gemini X for the product or service giving rise to the claim in the 12 months preceding the event. Nothing in these Terms limits liability that cannot be limited by law.

16) Indemnification

You agree to defend, indemnify, and hold harmless Gemini X and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

17) Suspension & Termination

We may suspend or terminate your access (and delete or disable accounts) at any time, with or without notice, if we believe you violated these Terms, present a risk, or for any business reason. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations, indemnities, governing law) will continue.

18) Changes to the Services & to These Terms

We may modify or discontinue the Services (in whole or part) at any time. We may update these Terms from time to time; the updated version will be effective when posted, unless a later date is stated. Your continued use after changes means you accept the updated Terms.

19) Compliance, Export, & Sanctions

You must comply with applicable laws and regulations, including Qatar law and any relevant trade, export control, and sanctions regulations. You represent you are not subject to sanctions or located in a prohibited jurisdiction.

20) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply issues, epidemics, government actions, power or network failures.

21) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts of Doha, Qatar. We each waive any objection to venue or inconvenient forum.

22) Notices

We may send legal notices to the email or address associated with your account, via in-site messaging, or by posting on the Services. You may send notices to:

23) Entire Agreement & Miscellaneous

These Terms (plus policies referenced here) are the entire agreement between you and Gemini X and supersede prior understandings about the Services. If any provision is found unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale.
